Can someone please explain about the £5000 a year the charity has to make to be registered.
Can it be from a one off donation? Can it come within a week of starting up, does it matter where it comes from ?

I am not sure that you have to have £5K to become a charity - the guidance just says 
You must apply to register your charity if: [the charity] income is at least £5,000 per year or it’s a charitable incorporated organisation (CIO)
This would seem to indicate that you can apply for registration if you don't have that turnover. My understanding is that they would want to see that you intend to turnover more than £5K - they are don;t want thousands of small charities that only spend £100 a year on postage.

Small unregistered charities are not required to register with the Charity Commission. However, the Commission will consider an application to voluntarily register a charity with an annual income of less than £5,000 in "exceptional circumstances", such as if it can be proved that a registered charity number is necessary to access a significant offer of funds (see Practice note, Charity Commission: what it does and where to access its services and guidance: Applying to register a charity).
I think it clarifies the position quite well.

This only applies to charitable trusts and companies, not CIOs and CIOs are usually the best option anyway.

Johny Lee   A charitable company is registered with 2 regulators and a CIO only 1, with no minimum income requirement.  But CIO is probably not best choice, if you intend to take out commercial debt, such as a mortgage.

You can become a CIO if you didn't have the £5k. We didn't have the £5k to start with so we are still a registered charity but we are a CIO. We only do one set of accounts to the Charities Commission, so we're not a Limited Company having to do 2 sets of accounts

Johny Lee   I think you may have to 'gift' the money to the charity if it's personal money. Have you spoken to a charity's accountant? Take a look at the Gov U.K. site on this - https://www.gov.uk/guidance/get-funding-to-start-a-charity

You will need to show that you have already had income of £5,000 when you apply to register as a charity. It can be a one off donation from any (legal!) source, but should be fairly recent. You don't need to meet this requirement if you are registering as a Charitable Incorporated Organisation (CIO).

Johny Lee   Donations to charity are free of tax (provided the donor receives no benefit, so raffle tickets etc don't count). If you are a UK tax payer, a donation from taxed income entitles the charity to claim back the tax you have already paid at source. And if you pay higher rate tax, you can reclaim the difference between the basic rate and higher rate tax paid. The charity can claim Gift Aid back for up to four years after the donation, provided the donor has made a Gift Aid declaration.
