Standard service agreements

Ops

Jo Stone Treasurer - Trustee (Voluntary) at The Youth Counselling Project Posted 1 year ago

Hello
We are a small registered charity using the services of independent self employed therapists. They are not employees of the charity.
We are reviewing our current service agreements so that they form a properly legal document but are simple and clear without too much legal jargon. An employment solicitor will draw one up for us but it is very costly.
How do other similar charities go about this?
Are there any proforma agreements that you know of?

I think all you need is a simple document outlining what you are expecting the therapist to do and how and when those services are to be remunerated.   The document should definitely clarify that this is self employment case and not PAYE.
I suppose the most important point to consider is how to clarify professional liabilities etc or is this covered by insurance?
Do the clients pay the Therapists or do they pay the Charity?

Mervyn Thomas   thank you for that Mervyn.
The actual recipients of the therapy sessions pay nothing. The charity pays for the sessions. The therapists send us an invoice every month for the sessions they have done. This is checked by the Treasurer against a calendar of dates sent by each therapist at the beginning of each school term.
Therapists are obliged to inform the charity of any absences or changes.
We basically only pay them for sessions completed.
