This question is from a member of our community that wishes to remain anonymous:
I work for a project, which is currently part of a not for profit company limited by guarantee. Not all of its work is charitable, and we have decided to seek independent status for the project and apply for CIO status.Â
However, we feel we need to establish ourselves as a separate organisation from the current company before making the CIO application to avoid confusion (the parent company has made unsuccessful applications to be a CIO) and to ensure we can employ staff/take on SLAs etc. We have been advised that we should register as a new company limited by guarantee, but I am concerned that this will then start a countdown to us needing to do the full CIO application, as our income would be over £5000.Â
Does anyone know how quickly a new company is expected to register with the Charity Commission? Would setting up as a CIC for the interim period make more sense?
