The legislation concerning working with vulnerable groups in Scotland is changing at the end of this month. The scope of who needs to be checked is expanding to cover those "with power or influence". Disclosure Scotland, our regulator, have clarified this will mean our trustees will come into scope. ["Our" = we're a charity regulated by OSCR constituted as an unincorporated association.]
It was a bit of an ohhhhhh moment as myself and our disclosure signatory worked together and realised what was coming. Not a huge issue bar the number of folk to process, and no cost to us so all good.
I dropped a note to our Chair just as a heads up that all of the committee would need to be warned.
Her response blind sided me; it's only the three office bearers who are trustees and whether they need to go through the scheme is up for discussion. The rest of the committee aren't trustees.
So, quick check of our dog's dinner of a constitution (about to be reviewed) and sections 3, 4 & 6 of the constitution essentially gives voting rights, full management responsibility and control over allocation of grants to the General Committee. So to me that means all members of our General Committee" are de facto trustees.
Or am I going senile and I'm fundamentally missing something?
